ORDER. On July 22, 2026, Defendant Timothy Irwin filed a "Stipulation of Dismissal of Defendant Timothy Irwin Without Prejudice" [Doc. 29]. The Stipulation is "[p]ursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii)," and it is signed by all Parties [ See id. ]. But Rule 21, not Rule 41, controls when parties seek to drop a "party" rather than dismiss "an action." See Letherer v. Alger Grp. , 328 F.3d 262, 266 (6th Cir. 2003), overruled on other grounds by Blackburn v. Oaktree Cap. Mgmt., LLC , 511 F.3d 633, 636 (6th Cir. 2008). Dropping Defendant Irwin would not resolve the entire action, so the Court construes the Parties' stipulation as a Motion under Rule 21. See id. No Party opposes the Court dismissing the claims against Defendant Irwin, [ see Doc. 29], and no Party would be prejudiced, see Espinosa v. First Advantage Background Servs. Corp. , 343 F.R.D. 414, 415-16 (S.D. Ohio 2023). And the terms are just. See Fed. R. Civ. P. 21. So, the Court (1) GRANTS the Parties' Motion [Doc. 29], as construed under Rule 21; (2) DROPS Defendant Irwin from this action, and (3) DISMISSES Plaintiff's claims against Defendant Irwin without prejudice.
