MINUTE ORDER granting9 American Sportfishing Association (ASA) and Coastal Conservation Association's (CCA) Motion to Intervene: "On timely motion, the court must permit anyone to intervene who...claims an interest relating to the property or transaction that is the subject of the action, and is so situated that disposing of the action may, as a practical matter, impair or impede the movants ability to protect that interest, unless existing parties adequately represent it." Fed. R. Civ. P. 24(a)(2). Intervention as of right under Rule 24(a)(2) turns on four factors: "(1) the timeliness of the motion; (2) whether the applicant claims an interest relating to the property or transaction which is the subject of the action; (3) whether the applicant is so situated that the disposition of the action may as a practical matter impair or impede the applicants ability to protect that interest; and (4) whether the applicant's interest is adequately represented by existing parties." Fund for Animals, Inc. v. Norton , 322 F.3d 728, 731 (D.C. Cir. 2003) (citation modified). Here, all four factors favor intervention by ASA and CCA. First, the motion is timely. Plaintiffs filed their Complaint on May 5, 2026, and their motion for a preliminary injunction on May 10, 2026. ASA and CCA moved to intervene just four days later, on May 14, 2026. They also represent that they can comply with the Court's existing briefing and hearing schedule. Thus, their intervention will not require any modification to that schedule. Second and third, ASA and CCA have cognizable interests that may be impaired by this litigation. ASA and CCA represent recreational anglers and the recreational fishing industry, both of which have an interest in preserving access to South Atlantic red snapper fishing opportunities authorized through the challenged exempted fishing permits. Recreational anglers who fish for South Atlantic red snapper, as well as the businesses that support those activities, would suffer injury if those fishing opportunities were eliminated. See Crossroads Grassroots Policy Strategies v. Fed. Election Comm'n , 788 F.3d 312, 316 (D.C. Cir. 2015). Fourth, ASA and CCA's interests are not adequately represented by the existing parties. Plaintiffs do not represent those interests because they seek to invalidate the challenged fishing opportunities. Nor is the Government an adequate representative. Although the Government and ASA and CCA may share some objectives, the Government represents the broader public interest, while ASA and CCA seek to protect the narrower interests of recreational anglers and the recreational fishing industry. See Fund for Animals , 322 F.3d at 737; see also Natural Res. Def. Council v. Costle , 561 F.2d 904, 912 (D.C. Cir. 1977). Therefore, it is hereby ORDERED that ASA and CCA's Motion to Intervene is GRANTED. It is FURTHER ORDERED that ASA and CCA's motion, incorporated memorandum, and supporting affidavit together satisfy Rule 24(c). See Mandan, Hidatsa & Arikara Nation v. U.S. Dep't of the Interior , No. 20-cv-1918, 2020 WL 12655958, at *3 (D.D.C. Aug. 27, 2020). It is FURTHER ORDERED, consistent with the briefing and hearing schedule governing this case, ASA and CCA shall file an opposition to Plaintiffs' motion for a preliminary injunction on or before May 18, 2025, and shall appear on May 20, 2026 at 10:00 AM in Courtroom 23A before Judge Contreras for a hearing on the motion.
