6 6 1 pgs order Order of Dismissal Fri 09/04 5:08 PM
ORDER OF DISMISSAL: Plaintiff filed the Complaint in this case on May 20, 2026. ECF No. 1. On August 27, 2026, the Court had not received notice that the Complaint had been served on Defendants and then issued an Order to Show Cause why this action should not be dismissed in its entirety under Federal Rule of Civil Procedure 4(m). ECF No. 22. Fed. R. Civ. P. 4(m) provides plaintiffs 90 days to perfect service on defendants. To date, Plaintiff has not provided any notice or proof of service to the Court and has also failed to respond to the Court's Order to Show Cause. "If a defendant is not served within 90 days after the complaint is filed, the courton motion or on its own after notice to the plaintiff-must dismiss the action without prejudice against that defendant or order that service be made within a specified time." Fed. R. Civ. P. 4(m). Because Plaintiff has not provided proof of service to the Court or responded to the Court's Order to Show Cause under Rule 4(m), this action is hereby DISMISSED WITHOUT PREJUDICE. The Clerk of Court is respectfully directed to terminate this case. SO ORDERED. (Signed by Judge Andrew L. Carter, Jr on 9/4/2026) (ar)

5 5 1 pgs order Order to Show Cause Thu 08/27 1:27 PM
ORDER TO SHOW CAUSE: On May 20, 2026, Plaintiff filed a Complaint in the instant case. ECF No. 1. Rule 4(m) of the Federal Rules of Civil Procedure provides: If a defendant is not served within 90 days after the complaint is filed, the courton motion or on its own after notice to the plaintiff-must dismiss the action without prejudice against that defendant or order that service be made within a specified time. But if the plaintiff shows good cause for the failure, the court must extend the time for service for an appropriate period. Under this rule, Plaintiff was required to serve Defendants no later than August 20, 2026. The 90-day period permitted under Rule 4(m) has expired. To date, there has been no proof of service filed with respect to the Defendants, nor has there been any application for the extension of time that shows good cause for such failure. Accordingly, Plaintiff is hereby ORDERED TO SHOW CAUSE in writing no later than September 3, 2026, why this case should not be dismissed without prejudice pursuant to Rule 4(m). SO ORDERED. (Signed by Judge Andrew L. Carter, Jr on 8/27/2026) Show Cause Response due by 9/3/2026. (ar)

4 4 order Standing Order re Cases Filed By Pro Se Plaintiffs Tue 05/26 1:37 PM
STANDING ORDER IN RE CASES FILED BY PRO SE PLAINTIFFS (See 24-MISC-127 Standing Order filed March 18, 2024). To ensure that all cases heard in the Southern District of New York are handled promptly and efficiently, all parties must keep the court apprised of any new contact information. It is a party's obligation to provide an address for service; service of court orders cannot be accomplished if a party does not update the court when a change of address occurs. Accordingly, all self-represented litigants are hereby ORDERED to inform the court of each change in their address or electronic contact information. Parties may[LINK:consent to electronic service] to receive notifications of court filings by email, rather than relying on regular mail delivery. Parties may also ask the court for[LINK:permission to file documents electronically] . Forms, including instructions for consenting to electronic service and requesting permission to file documents electronically, may be found by clicking on the hyperlinks in this order, or by accessing the forms on the courts website, nysd.uscourts.gov/forms. The procedures that follow apply only to cases filed by pro se plaintiffs. If the court receives notice from the United States Postal Service that an order has been returned to the court, or otherwise receives information that the address of record for a self-represented plaintiff is no longer valid, the court may issue an Order to Show Cause why the case should not be dismissed without prejudice for failure to comply with this order. Such order will be sent to the plaintiffs last known address and will also be viewable on the court's electronic docket. A notice directing the parties' attention to this order shall be docketed (and mailed to any self-represented party that has appeared and has not consented to electronic service) upon the opening of each case or miscellaneous matter that is classified as pro se in the court's records. (Signed by Chief Judge Laura Taylor Swain on 3/18/2024) (sj)
