This Court has determined that the United States Court of Appeals for the Federal Circuit has exclusive jurisdiction over the district court's decision to dismiss the amended complaint asserting a patent infringement claim. See 28 U.S.C. § 1295(a)(1). However, this Court has further determined that transfer to the Federal Circuit would not be "in the interest of justice." See 28 U.S.C. § 1631. Upon due consideration, it is hereby ORDERED that the motion is DENIED and the appeal is DISMISSED because it "lacks an arguable basis either in law or in fact." Neitzke v.
