ORDER GRANTING STIPULATION TO LIFT STAY FOR LIMITED PURPOSE OF SEEKING SEEK SUMMARY JUDGMENT RULINGS by Judge Andre Birotte Jr.: The Court approves the parties' Stipulation1574 . The stay is hereby lifted as to cases 2:22-cv-04999-AB-PVC, 2:22-cv-05000-AB-PVC, and 2:22-cv-05001-AB-PVC for the limited purpose of seeking rulings on the following legal issues: (1) Whether some or all of the HOP Georgia Plaintiffs' FBPA claims are barred by the HOP Georgia Plaintiffs' alleged failure to provide Ford with notice under OCGA Section 101399(b); and (2) Whether the HOP Georgia Plaintiffs' Magnuson Moss claims are barred because they did not first follow the optional informal dispute resolution procedures set forth in the applicable Ford warranty booklet. Within 30 days of the date of this Order, Ford must product copies of any and all notice letters in its possession, custody or control served on Ford by counsel for proposed class action plaintiffs in other Ford DPS6 cases. The Court sets the following briefing schedule for Ford's summary judgment motion: Ford's Motion for Summary Judgment on the above issues is due by 6/21/2024. The HOP Georgia Plaintiffs Response is due by 7/19/2024. Ford's Reply is due by 8/2/2024. A hearing is set for 8/30/2024. (gk) |
